Terms and Conditions
These terms and conditions govern your engagement with High Vision Renovations for all renovation, construction, and design services. By accepting our quotation or engaging our services, you agree to be bound by these terms.
Definitions and Interpretation
In these terms, "we", "us", and "our" refer to High Vision Renovations ABN 88 661 992 187. "You" and "your" refer to the client engaging our services. "Services" means all renovation, construction, design, and consultation work we provide. "Project" refers to the specific work outlined in your accepted quotation.
Quotations and Acceptance
All quotations remain valid for thirty days from the date of issue unless otherwise specified. Quotations are based on the scope of work discussed and any site inspections conducted. Acceptance of our quotation constitutes a binding agreement to proceed with the project under these terms.
Should additional work be required beyond the original scope, we will provide supplementary quotations for your approval before proceeding. Any variations to the original quotation must be agreed in writing.
Payment Terms
Payment schedules vary according to project size and complexity. For projects exceeding $10,000, we typically require a deposit of 30% upon acceptance of the quotation, with progress payments at agreed milestones. For smaller projects, payment terms will be specified in your quotation.
All invoices are payable within seven days of issue. We accept payment by bank transfer, credit card, or cheque. Late payments may incur interest at the rate of 2% per month on outstanding amounts.
Project Timeline and Delays
We pride ourselves on completing projects within agreed timeframes. However, completion dates are estimates based on normal working conditions. Delays may occur due to weather, material availability, variations to the scope of work, or circumstances beyond our control.
We will keep you informed of any potential delays and work diligently to minimise their impact on your project. Time remains of the essence in our agreements, and we commit to progressing work as efficiently as possible.
Materials and Workmanship
High Vision Renovations guarantees all workmanship for seven years from project completion. This warranty covers defects arising from our workmanship but excludes normal wear and tear, misuse, or damage caused by others.
We source premium materials from trusted suppliers and pass on all manufacturer warranties to you. Should any defects arise in materials supplied by us, we will coordinate warranty claims on your behalf.
Client Responsibilities
You must provide clear access to work areas and ensure the site is safe for our team. Please remove or protect valuable items before work commences. You are responsible for obtaining any necessary permits unless we have specifically agreed to arrange these on your behalf.
Timely decisions on selections such as fixtures, finishes, and colours are essential to maintain project schedules. We will provide guidance and recommendations, but final choices remain your responsibility.
Variations and Additional Work
Changes to the agreed scope of work may affect both timeline and cost. All variations must be documented in writing and approved by both parties before implementation. We will provide clear pricing for any additional work requested.
Minor adjustments that do not materially affect cost or timeline may be accommodated without formal variation, at our discretion.
Health and Safety
Safety is paramount on all High Vision Renovations projects. Our team adheres to all relevant workplace health and safety regulations. We maintain comprehensive insurance coverage including public liability and workers compensation.
For your safety, please avoid entering active work areas without our supervision. We will designate safe access routes where necessary and communicate any specific safety requirements for your project.
Intellectual Property
Design concepts, plans, and specifications created by High Vision Renovations remain our intellectual property until full payment is received. Upon final payment, ownership of project-specific designs transfers to you, though we retain the right to use photographs and descriptions of completed work for promotional purposes.
Cancellation and Termination
Should you wish to cancel a project after accepting our quotation but before work commences, a cancellation fee may apply to cover costs already incurred.
Either party may terminate the agreement for material breach after providing written notice and reasonable opportunity to remedy the breach. In case of termination, you must pay for all work completed to date plus any cancellation costs.
Dispute Resolution
We strive to resolve any concerns promptly and professionally. Should disputes arise, we encourage open communication to find mutually agreeable solutions. If informal resolution proves unsuccessful, both parties agree to attempt mediation before pursuing other remedies.
These terms are governed by Victorian law, and any legal proceedings must be brought in Victorian courts.
Privacy and Confidentiality
We respect your privacy and maintain confidentiality regarding your project details, personal information, and property. Information is shared only with team members and suppliers as necessary to complete your project.
We may request permission to photograph completed work for our portfolio. You may decline this request without affecting our services.
Insurance and Liability
High Vision Renovations maintains comprehensive insurance coverage including public liability of $20 million. We accept liability for damage or loss caused by our negligence but exclude consequential or indirect losses.
Our total liability under any agreement is limited to the value of the project unless mandatory consumer protection laws provide otherwise.
General Provisions
These terms constitute the entire agreement between parties and supersede any previous understandings. Amendments must be made in writing and signed by both parties.
If any provision proves unenforceable, the remaining terms continue in full effect. Our failure to enforce any right does not constitute a waiver of that right.
